What information have we collected about you in the last 12 months, why do we collect, and who have we disclosed it to? 

When you retain us for the purpose of providing you with legal services and advice.  We collect information from you necessary to provide you with the legal services you have requested.  This information may include identifiers such as your name, postal address, Internet Protocol address, email address, Social Security number, driver’s license number, employment history, professional licenses, bank account number, credit card number, and any other financial information or medical information.   In addition, when you pay for our services, we collect your bank information to process the payment.  We use this information to provide you with the legal services that you have requested and to bill you for our services.  We may disclose your information with our service providers, such as experts, investigators, and litigation support services.  Our service providers are obligated to keep your information confidential.

When you visit our offices.  When you attend events at our office, we may take your photograph.  We use your photograph to provide you and us with a fun memory of the event.  We also use security cameras to collect video images of persons in our parking structure and in some building locations.  We may share this information with our service providers such as security personnel.  We use this information to maintain the safety and security of our premises, property, and people.

When you provide your contact information to us.  We collect your name, title, mailing address, email address, telephone number and business affiliations.  We use this information to communicate with you and for marketing purposes.  We share your contact information with our service providers who manage our website and distribute our publications, cookie alerts and invitations.  You may opt out of our mailing list at any time by clicking here.

When you apply for a job with us or become our employee or independent contractor.  We collect information from you necessary to process your application for employment or to maintain our working relationship with you.  This information may include identifiers such as your name, postal and e-mail address, telephone number(s), emergency contact number(s), Social Security number, Tax Identification number, date of birth, driver’s license number, passport number, tax status and signature; professional information such as your employment history, professional licenses, certifications, bar admissions and publications; educational information such as the educational institutions you have attended, your degrees and certifications; biometric information such as your professional photograph and photographic images from security cameras in certain locations in our offices and surrounding areas; financial information such as your bank account information;  medical information and information regarding your dependents and beneficiaries; information regarding your electronic network activity using our equipment such as browsing history, usage and e-mail content; and characteristics of protected classifications such as your race or ethnicity, gender, disability status and veteran status, if you choose to self-identify.  We use this information to determine your qualifications and make employment decisions.  We also use this information to provide you with company sponsored benefits, to review and consider accommodations for work arrangements, and to pay you for your services.  We provide you with information about the categories of information we collect and what we do with that information in a separate Notice at Collection of Personal Information.

When you visit our website.  We collect information from you using “cookies.”  (Our Cookie Policy is here.)  This information may include internet and other electronic network activity, such as your Internet Protocol address, the type of browser and operating system you used to access our website, the date and time of your visit, the pages you visited, and any previous website you accessed to reach our website.  We use this information to improve your experience on our website, to track visits to our website and to see how visitors move about the pages.  We share this information with our service providers who manage our website, analyze activity on our website, and audit it for security purposes.  All of the information that we collect in this manner is aggregated and is not personally identifiable to you.

What are the business purposes for which we have disclosed your personal information?

In the last 12 months, we have disclosed the categories of personal information listed above to our service providers, such as experts, investigators and litigation support vendors, for specific, limited business purposes including to provide you with requested legal services, to facilitate billing for services and costs incurred on your behalf, to comply with our own legal and regulatory obligations, and to conduct background checks.

How do we obtain your personal information?

We obtain personal information directly from you and indirectly from you, such as from publicly available sources.

Have we sold or shared your information with third parties in the last 12 months? 

No.  We do not and will not sell or share your personal information as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act.

Do we sell or share personal information of minors under the age of 16 without affirmative authorization? 

No.

Do we use or disclose sensitive personal information for purposes other than those permitted by law?  

No.

What rights do you have regarding information that we have collected in the last 12 months? 

  • Right to Know: You have the right to request that we inform you of (1) the categories of personal information we have collected about you, (2) the categories of sources from which we have collected the personal information, (3) the business or commercial purposes for which we have collected, sold or shared your personal information, (4) the categories of third persons to whom we disclosed your personal information; and (5) the specific pieces of personal information we have collected about you.   We have the right to deny your request in certain circumstances.

  • Right to Delete:  You have the right to request that we delete personal information that we have collected from you. We have the right to deny your request to delete in certain circumstances.
  • Right to Correct:  You have the right to request that we correct any inaccuracies in the personal information that we maintain about you.  We have the right to deny your request to correct in certain circumstances, considering the nature of the personal information and the purposes of the processing of the personal information.
  • Right to Limit the Sale or Sharing of Personal Information:  You have the right to request limitations on the sale or sharing of your personal information.  We do not sell or share your personal information.
  • Right to Limit Sensitive Personal Information:  You have the right to request limitations on the use and disclosure of your sensitive personal information in certain circumstances.  We use and disclose sensitive personal information only as permitted by law.
  • Right to Non-discrimination.  You have the right to not be denied goods or services, charged different prices, be provided with a different level or quality of service, or be retaliated against because you have exercised your privacy rights conferred under the California Consumer Privacy Act, as amended by the California Privacy Rights Act.

How do you exercise your privacy rights regarding the information that we have collected in the last 12 months?

How do we verify your request to know, delete or correct information?    

Before we can grant your request to know, delete, or correct your personal information, we will verify your identity in one or more of the following ways:

  • A Keesal, Young & Logan shareholder may call you at a telephone number that is known to us, to confirm that you have submitted a request.
  • If you submit a request to know categories of information that we have collected about you, we will verify your identity to a reasonable degree of certainty.  This means that we will match at least two pieces of personal information provided by you with personal information maintained by us, which we have determined are reliable for the purpose of verifying your identity.  In some instances, there is no reasonable method by which we can verify the identity of the consumer to the degree required.  This is the case, for example, when you visit our website.  In that circumstance, we collect your IP address and other information as described above (“When You Visit Our Website”), but we do not associate this information with any named actual person or account.
  • If you submit a request to know specific pieces of personal information that we have collected about you, we will verify your identity to a reasonably high degree of certainty.  This means that we will match at least three pieces of personal information provided by you with personal information maintained by us, which we have determine are reliable for the purpose of verifying your identity, together with a signed declaration under penalty of perjury from you stating that you are the individual whose personal information is the subject of the request.
  • If you submit a request to delete or correct information that we have collected from you, the manner in which we will verify your identity will depend on the sensitivity of the personal information and the risk of harm to you by unauthorized deletion or correction.  If the personal information is not sensitive, we will match at least two pieces of personal information provided by you with personal information maintained by us, which we have determined are reliable.  If the personal information is sensitive, we will match at least three pieces of personal information provided by you with personal information maintained by us, together with a signed declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.

Additional information about requests to know, delete, or correct:

  • We are not obligated to respond to a request to know submitted by or on behalf of the same consumer more than twice within a 12-month period.
  • If we cannot verify the identity of the person submitting or authorizing a request to know, delete, or correct, we may deny the request.

Can your authorized agent submit a request to know, delete, or correct on your behalf? 

Yes.  If you use an authorized agent to submit a request to know, delete, or correct personal information, and have not provided your agent with a power of attorney, we will require that your authorized agent provide us with proof that you provided the agent signed permission to submit the request on your behalf.  We may also require you to either (1) verify your identity with us, using the methods described above, or (2) directly confirm with us that you provided the agent permission to submit the request on your behalf.  We may deny a request from an agent who fails to submit proof that they have been authorized by you to submit a request on your behalf.

Can other parties collect personal information about your online activities over time and across different websites when you use our website?

No.  We do not allow third parties to collect personal information about your activities while you use www.kyl.com.

Does Keesal, Young & Logan respond to “Do Not Track” (DNT) signals?

No.  We do not track our visitors over time or across third-party websites to provide targeted advertising, and therefore we do not respond to DNT signals.

What if you link to another website from www.kyl.com?

Our website contains links to websites that are controlled by third parties and access to third-party services.  These links are provided to you as a convenience, and we are not responsible for the content, action or performance of any linked website.  Please be aware that other websites have their own privacy policies, and their data gathering practices may be different from ours.  We are not responsible for the information collected by other websites if you link to them from our website.  We cannot guarantee how those sites use cookies or whether they place cookies on your computer that may identify you.  You should carefully review the privacy policies of each website you visit to understand how it collects and uses information.

How do we protect your personal information? 

We have in place technical and organizational security measures to protect the personal information we collect and maintain about you from unauthorized, improper or unlawful access, use, disclosure, alteration or destruction.

What if we change our Privacy Policy? 

We may update our Privacy Policy from time to time by updating this page.  If we materially change our Privacy Policy, we will post the new Privacy Policy on this page.
