On September 30, 2020, Governor Newsom signed SB 973, which requires private employers in California with 100 or more employees and who are required to file an annual Employer Report (EEO-1) under federal law to submit payroll data to the California Department of Fair Employment and Housing (DFEH). The new law is aimed at addressing pay inequities based on gender, race, and ethnicity.

Employers must submit their pay data reports to DFEH on or before March 31, 2021, and then on or before March 31 each year thereafter. Employers must submit their pay data report using DFEH’s online portal. The portal, user guide, templates, and FAQ page can be accessed here.
