Health Care

Keesal, Young & Logan serves a wide range of health care providers, including medical centers, hospitals, managed care organizations, long-term care facilities, mental health centers, IPAs, doctors and home health agencies.  We represent these providers in complex litigation, regulatory and criminal matters, as well as providing ongoing legal advice on a day-to-day basis.  Our health care related experience includes such diverse areas as Stark Act violations, Federal and state False Claims Act claims, Federal healthcare program fraud, Worker’s Compensation fraud, RICO claims, whistleblower claims, qui tam actions, medical malpractice,  medical records confidentiality and consent to treatment issues, antitrust and unfair competition issues and a wide range of employment matters.  In connection with these matters and otherwise, we are extremely experienced in managing large scale eDiscovery projects.

As part of our health care advisory practice, we consult with clients on Medicare/Medicaid reimbursement, appeals and compliance, medical staff credentialing and discipline, medical staff/hospital relations, managed care issues, licensing and certificate of need issues and cyber security and risk management.  We also represent health care providers in corporate and transactional matters, including contract issues, asset sales, real estate matters and lease negotiations. We routinely assist clients in reviewing proposed new statutes and regulations and with review of internal policies and procedures, and  discretely advise clients on both civil and criminal issues and on internal investigations and self-reporting.

We recognize that health care related litigation can be extremely complex and costly; our objective is two-fold.  First, to assist clients in a preventing litigation through careful compliance review, implementation of risk management strategies and aggressive but pragmatic pre-litigation evaluation and negotiation.  Second, where litigation is unavoidable, to aggressively resolve disputes in the most cost-effective manner possible. Based on our extensive litigation and trial experience as well as our nationally-recognized eDiscovery capabilities, we are uniquely positioned to review, analyze, synthesize and simplify cases involving complex issues, to sift through massive amounts of information and focus on what is important, compelling and necessary to obtain the best result.
